Washington & Oregon Building Performance Standards
Washington and Oregon have adopted Building Performance Standards to reduce greenhouse-gas emissions and improve energy efficiency in existing buildings. Here's what applies to your property in each state.
Washington
Washington State Clean Buildings Performance Standard (CBPS)
The Washington Clean Buildings Performance Standard (CBPS) sets energy performance requirements for covered commercial and multifamily buildings. Buildings are assigned to Tier 1 or Tier 2 based on size and property type.
Applies to commercial buildings 50,000 square feet and larger, excluding multifamily properties. These buildings are required to benchmark and report their energy use, adopt an Operations & Maintenance (O&M) Program, and develop an Energy Management Plan (EMP).
Additionally, Tier 1 properties must meet state-defined Energy Use Intensity (EUI) targets. Buildings that exceed their designated targets are mandated to undergo a certified energy audit and implement energy-efficient measures.
Applies to commercial buildings between 20,000 and 50,000 square feet, as well as all multifamily properties larger than 20,000 square feet. These buildings are required to benchmark and report their energy use, adopt an Operations & Maintenance (O&M) Program, and develop an Energy Management Plan (EMP).
They are not mandated to meet specific performance targets yet.
Incentives and grants are available — potentially covering the entire cost of service.
Oregon
Oregon State Building Energy Performance Standard (BEPS)
The Oregon BEPS requires covered commercial buildings to benchmark energy use, evaluate building performance, and meet state-established performance requirements as the program phases in.
Applies to commercial, non-residential, hotel, and motel properties with a gross floor area of 35,000 square feet and larger. These covered buildings are required to benchmark their energy use, adopt an Operations & Maintenance (O&M) Program, and develop an Energy Management Plan (EMP).
Additionally, Tier 1 properties must meet state-defined Energy Use Intensity (EUI) targets. Buildings that exceed their designated targets are mandated to undergo a certified energy audit, perform a life-cycle cost assessment, and implement cost-effective energy-efficiency measures.
Compliance dates are phased by size — 2028 (200,000+ sq ft), 2029 (90,000–200,000 sq ft), and 2030 (35,000–90,000 sq ft).
Applies to two categories of properties: (1) smaller commercial, non-residential, hotel, and motel buildings between 20,000 and 35,000 square feet, and (2) all covered residential and institutional properties 35,000 square feet and larger — including multifamily residential, hospitals, schools, universities, dormitories, and senior-care facilities.
Covered Tier 2 buildings are required to benchmark and report their energy use and Energy Use Intensity targets, but are not currently mandated to perform energy audits or meet specific performance thresholds. The compliance reporting deadline for Tier 2 properties is July 1, 2028.
